End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Dirk Jensen ("Author") for the Everstra software, including the Everstra Live module and any other Everstra modules, together with their bundled components and documentation (collectively, the "Software").
By installing, activating, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install, activate, or use the Software.
1. Grant of License
The Author grants you a non-exclusive, non-transferable, revocable license to install and use the Software free of charge on network cameras that you own or lawfully operate, for personal or organisational purposes, subject to the terms of this Agreement.
This license covers use of the Software in binary (executable) form only.
2. License Activation and Hardware Binding
Use of the Software beyond any trial period provided in the Software requires a license key obtained from the Author.
- License keys are currently issued free of charge. The Author reserves the right to change this for future versions (see Section 9).
- A license key is bound to the individual camera hardware (identified by its hardware address) for which it was issued and is non-transferable to other hardware.
- The license is valid for the lifetime of that camera hardware, not for the lifetime of the User.
- If the Software is uninstalled, the license key may be lost and must be requested again.
- The issuance of a license key is at the sole discretion of the Author. There is no entitlement or legal claim to receive a license key. The Author may decline any request without stating a reason.
3. Permitted Use
You may install and run the Software on camera hardware you own or lawfully operate, and configure it for your own streaming and related purposes.
4. Restrictions
You may not:
- redistribute, resell, sublicense, rent, lease, or otherwise make the Software (in whole or in part) available to third parties, except through channels provided by the Author;
- modify, adapt, translate, or create derivative works of the Software;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent this restriction is expressly prohibited by applicable mandatory law;
- remove, disable, bypass, or circumvent any license verification or activation mechanism of the Software;
- remove or alter any copyright, trademark, or other proprietary notices.
These restrictions apply only to the Software authored by the Author and do not apply to bundled third-party open-source components, which remain under their own licenses (see Section 5).
5. Third-Party Components
The Software includes third-party open-source components, which remain solely under their respective licenses. Nothing in this Agreement limits any rights granted to you by those third-party licenses. Details and notices for these components are provided in the accompanying NOTICE document.
6. User-Provided Content (Audio and Other Inputs)
The Software's default settings do not include any third-party material.
You may optionally provide your own content (for example, audio files or audio from a network share) to be used by the Software. You are solely responsible for all rights in such user-provided content (including copyright, neighbouring and usage rights), and you warrant that you hold the rights required to use and publicly perform that content within any stream you produce. The Author provides a neutral technical tool only and assumes no responsibility or liability for content you provide or transmit.
7. Intellectual Property
The Software is licensed, not sold. The Author retains all right, title, and interest in and to the Software, except for the third-party components covered by Section 5. "Everstra" and related module names are designations used by the Author for the Software.
8. No Warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE AUTHOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT IT WILL MEET YOUR REQUIREMENTS.
The Software is provided free of charge and without any service-level commitment. The Author is under no obligation to provide support, maintenance, updates, or bug fixes. Any support given is voluntary.
8a. Security and User Responsibility
The Author makes the official binaries available through the Author's own distribution channel and publishes a checksum (SHA-256 hash) for each binary so that Users can verify file integrity before installation.
You are responsible for:
- verifying the integrity of any downloaded file against the published checksum before installing it;
- the security of your own network, devices, and systems, including the use of appropriate antivirus, firewall, and security measures;
- ensuring that your use of the Software complies with the security policies of any network or organisation in which it is operated.
The Author is not responsible for files obtained from sources other than the Author's official distribution channel, or for files that have been modified, repackaged, or tampered with by any third party.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Author shall not be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or the use of or other dealings in the Software.
IN PARTICULAR, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AUTHOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF PROFITS, LOSS OF REVENUE, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF GOODWILL, OR DAMAGE TO OTHER SOFTWARE, HARDWARE, NETWORKS, OR SYSTEMS, EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable mandatory law (in particular, liability for intent, for gross negligence, and for injury to life, body, or health under German law). Where liability for slight negligence cannot be excluded, it is limited to the breach of essential contractual obligations ("Kardinalpflichten") and to the foreseeable, typical damage; any further liability for slight negligence is excluded.
10. Future Licensing
The Author reserves the right to change the licensing terms, including the price, for future versions of the Software. Terms in effect at the time you activated a given version remain valid for that version. Future or additional (including paid) versions may be offered under different terms.
11. Term and Termination
This Agreement applies for as long as you use the Software. It terminates automatically if you breach any of its terms. Upon termination, you must cease using the Software and remove it from your hardware. Sections 4, 5, 6, 7, 8, 9, and 12 survive termination.
12. Governing Language and Law
The English version of this Agreement is the sole binding version. Any translation is provided for information only.
This Agreement is governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the User's country of habitual residence remain unaffected.
13. Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
